On March 17, 2021, changes were made to the medical assistance in dying law (MAID). The revised law mainly modifies MAID eligibility criteria and safeguards in response to the Superior Court of Québec’s 2019 Truchon decision.
The law maintains the ability of an individual whose natural death is reasonably foreseeable, with revisions to conditions, to receive MAID but also added provisions that no longer require a person’s natural death to be reasonably foreseeable as an eligibility criterion for MAID. The AHS summary of Bill C-7 changes to medical assistance in dying outlines the changes in three categories:
- all individuals seeking MAID,
- individuals whose natural death is reasonably foreseeable, and
- individuals whose natural death is NOT reasonably foreseeable.
